Limitation of Liability

Under no circumstances shall Execulia be liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of data, business interruption, or loss of profits, arising out of the use or inability to use our services or products. This limitation applies even if Execulia or an authorized representative has been advised of the possibility of such damages. If the use of our services or solutions results in the need for servicing, repair, or correction of equipment or data, you assume all associated costs.

Licensing Policy

All custom web applications, websites, and related deliverables developed by Execulia remain our property until full payment is received. We may use open-source frameworks or third-party software governed by their own licensing terms (e.g., MIT, GPL). Unless otherwise stated, clients are granted a non-exclusive, non-transferable license to use the final deliverables for their intended purpose. You may not claim intellectual or exclusive ownership over any of our pre-built code, plugins, or design assets.

Product & Service Compatibility

We ensure that our websites and web applications are compatible with the latest stable versions of widely used web browsers (e.g., Chrome, Firefox, Edge, Safari). While we strive for optimal cross-platform functionality, performance may vary based on device type, browser versions, and user environment.

Delivery

All project deliverables will be shared via secure channels upon receiving the agreed payment milestones. Timelines will be defined in the project agreement. Minor delays caused by unforeseen circumstances may occur; however, we will notify you promptly. Digital deliverables such as design files, code repositories, or deployment access will be provided only to the client’s authorized email address or account.

Updates & Maintenance

Post-deployment updates, feature enhancements, and maintenance services will be handled as per the service-level agreement (SLA) or maintenance plan purchased by the client. Updates outside the defined scope may incur additional charges.

Browser & Device Support

We aim to provide a consistent user experience across major browsers and devices. However, exact design or functional consistency across all devices (especially outdated browsers or unsupported devices) cannot be guaranteed.

Theme/Code Support

Clients can reach out for support via our official channels during business hours. The scope and duration of support will depend on the package or SLA purchased.

Price Changes

Execulia reserves the right to modify pricing for services, subscriptions, or maintenance plans at any time, with or without prior notice. Any price changes will not affect ongoing projects already under contract.

Refund Policy

Due to the nature of digital services, we do not offer refunds for completed work or services already delivered. If you wish to cancel an ongoing project, cancellation fees (for work completed till date) will apply. Please refer to our Refund Policy for detailed information.

Severability

If any provision of these Terms & Conditions is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.

Acceptance of Agreement

By using our services or engaging with Execulia, you acknowledge that you have read and agreed to these Terms & Conditions. We reserve the right to amend these terms at any time without prior notice.
